1. About this service
TradeandTell ("we," "our," or "the service") is a portfolio-tracking and social-following platform. Users record their own securities trades, and may follow other users to see those users' portfolios and trade activity. The service is provided as-is.
2. Not investment advice
NOTHING ON TRADEANDTELL IS INVESTMENT, FINANCIAL, OR TAX ADVICE. Portfolios, trade alerts, performance metrics, follow features, paid subscriptions, super-investor data, and any other content are information only. Each user is solely responsible for their own investment decisions. We are not a registered broker-dealer, investment adviser, or financial planner. Consult a licensed professional before making investment decisions.
3. Eligibility and account
You must be at least 18 years old and capable of forming a binding contract. You agree to provide accurate information at registration and to keep your password confidential. You are responsible for all activity under your account.
4. User content
You own the portfolios, notes, and other content you submit. By submitting content, you grant TradeandTell a worldwide, royalty-free license to host, display, share, and distribute it as needed to operate the service (including via embeds, RSS, and public discovery features when you mark content as public). You can revoke this license by deleting the content.
5. Trade entries
Trades you record on TradeandTell are either (a) priced by the platform at the time of submission using live market data, (b) queued by the platform and priced at the next live market print, or (c) imported via a connected brokerage API. We do not allow backdating or hand-typed prices on stock trades because the credibility of the platform depends on it. You agree not to attempt to circumvent this enforcement.
6. Paid follows
Some creators offer paid subscriptions to their portfolios. Payments are processed through Stripe. TradeandTell takes a 10% platform fee; the rest is paid out directly to the creator's connected Stripe account. Subscriptions renew monthly until canceled. Refunds are at the creator's discretion subject to applicable law.
7. Prohibited conduct
Don't: post unlawful content, impersonate others, attempt to manipulate prices or volumes, run automated scrapers against our public endpoints beyond reasonable use, or use the platform to coordinate or promote pump-and-dump schemes. We reserve the right to suspend or remove accounts at our discretion.
8. Termination
You can close your account at any time. We may suspend or terminate your access for breach of these terms, suspected fraud, or to comply with law. Sections 2, 4 (license to retained shared content), 9, and 10 survive termination.
9. Disclaimers and limitation of liability
The service is provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of market data, and non-infringement. To the maximum extent permitted by law, TradeandTell's liability for any claim arising from the service is limited to the greater of $100 or fees you paid us in the previous 12 months.
10. Governing law
These terms are governed by the laws of the State of Delaware, excluding conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware.
11. Changes
We may update these terms. We'll post the new version with a revised "Last updated" date. Material changes will be announced in-app or via email. Continued use after changes means you accept them.
